Construction Disputes

One of the attorneys at the firm helped represent an national builder for many years in state and federal courts involving claims regarding copyrighted architectural drawings, alleged construction defects, association and covenant issues, disputes with subcontractors over payment and performance, and disputes regarding land development and zoning.

The attorneys at the firm also have experience in writing a home warranty for a national builder and in writing contracts and subcontracts for builders.

Engaging in construction dispute practice often involves arbitration and mediation. The standard form of the contract used by realtors in Georgia contains an arbitration clause that, when initialed, generally requires buyers and builders to litigate their disputes.

Currently, the law firm is engaged in various representation of builders and home owners concerning houses and lots. Disputes involve the International Building Code, which is the state implemented building code to which contractor must adhere to in Georgia.

Disputes regarding construction defects can range from disputes about the color of paint that a contract required a contractor to provide, to the adequacy of the concrete foundation. Disputes can involve windows, failure to comply with construction codes, and failure to properly grade a property for drainage. Disputes can also arise in relation to the closing of a contract of sale of house, or between a real estate broker and a client regarding commissions or terms of sale.

Georgia recently implemented conditions for instituting a claim or arbitration under a new offer to cure statute. This provision requires a homeowner to follow certain steps before the homeowner can bring a claim against a builder for a construction defect.

The Georgia General Assembly also recently amended the codes to require contractors for residential construction to obtain professional licenses. Teague & Chambless, LLLP also has experience in advising builders regarding this law.
